Product Liability

In New York, when a manufacturer or seller distributes or sells a defective product and a consumer gets injured by the product, the manufacturer or seller can be sued and held liable under product liability and consumer protection laws. Product liability claims can be pursued on the basis of strict liability, negligence and/or breach of warranty. A consumer who is injured because of a defective product can allege claims for defective designs, manufacturing defects and/or failures to warn.
